This web-site is intended to be a friendly, enjoyable and useful experience, for all video game related transactions. With anything concerning transactions between two persons there are risks involved and you must understand all of these terms before joining.

If you find a listing that you feel is violating the general terms and conditions of this website as stated below please let us know immediately by contacting us.

Rights To Suspend or Terminate.

You agree that this website, in its own discretion, may terminate any auction or use of the service immediately and without notice if:

1. We believe that you are not abiding by the general rules of this website.
2. You have repeatedly broken a certain term.
3. You have listed a suspicious, fake, or pirated item.
4. We believe you to be a non paying bidder or shill bidder.
   

In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

Your Conduct.

You are solely responsible for the contents of your actions through this website. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. You must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.

You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation.

This website is intended to sell Video Games, associated hardware, accessories, and merchandise. Any other listings will be suspended and the user will be notified.

Pirated or bootleg items will be terminated immediately, and the local law enforcement will be notified by Game Gavel. Piracy and bootlegging is a serious crime and will not be tolerated.

Membership.

Membership to this website is only available to those who can form a legally binding contract. This web-site does not permit minors (under 16) to register. If any member fails to signup with their correct age the account will be terminated immediately.

GameGavel.com reserves the right to revoke membership if you are found to be violating the terms of service.

We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretense.

We occasionally conduct spot checks of auctions to verify the validity and legality of the auctions to ensure that items being auctioned and sold are legal. In the event that an auction is completed and it is found illegal in nature, or questionable we will forward it to the local law enforcement agency.

This Website is not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.

This website assumes no liability for the content of the listings. However if you fall victim of a fraudulent transaction we will assist you as much as we can.

GameGavel.com will act as a mediator between sellers and buyers on a case by case basis. This does not imply that GameGavel.com will bear any responsibility for the transaction, nor does it imply that GameGavel.com will be able to help remedy the situation.

All transactions on this website constitute a legally binding contract. If either party involved in the transaction does not comply with all that an auction, sale, or trade entails then legal action can be taken by the other party.

In the event of any legal actions taken by either party, all information that GameGavel.com has regarding the auction will be given to the proper authorities if requested. We, GameGavel.com, will fully cooperate with any investigations by law enforcement agencies.

Terms and Revisions.

Game Gavel reserves the right to change the terms of service to provide a safe trading environment. In the event of change in the Terms, Game Gavel will notify its members prior to the change.

GaveGavel's policies are rules and guidelines that help to create a safe, fair and enjoyable trading environment for all it’s members. As a seller, you are responsible for reviewing and understanding these selling policies, as well as all applicable laws and regulations as outlined in the Registration Form.

Violations of these policies may result in a range of actions, including:

1. Listing cancellation
2. Limits on account privileges
3. Account suspension
4. Forfeit of fees on cancelled listings

Rules for Listings:

1. Do not use words like LOOK, RARE, PIRATE, BOOTLEG, or any variation of the words using symbols as substitutes, in title listings. Auctions that do this will be edited at the discretion of the GameGavel.com administrators.
2. Place items in the correct sections. We have taken great time and care to ensure that we have adequate categories for your items; this will ensure an organized and easy to use website for everyone. Auctions will be edited at the discretion of the GameGavel.com administrators for organizational purposes.
3. Images used in your auctions are not allowed to be stock photos, no exceptions. Photos must be taken by the seller of the actually item being sold.
4. Avoid unnecessary and extraneous punctuation in titles.
5. Pirated items, or bootleg items are NOT allowed to be sold on GameGavel.com.
6. Non-Video Game related items are not permitted to be sold on GameGavel.com.
7. Sellers shall describe the items being sold to the best of their ability. They are ultimately responsible for the accuracy of their descriptions.

Sellers that violate these rules for listings may result in a range of actions as stated above.

Rules for Accepted Payments – Forms of payment that sellers may accept from buyers:

1. GameGavel.com will not place restriction upon buyers and sellers as to the online form of payments accepted. At a minimum, GameGavel.com will provide support for PayPal, and MoneyBookers. Sellers must make it clear which payments they take in the auction.
2. Personal Checks are acceptable, with a maximum of 14 day clearing time.
3. Money Orders and Cashier Cheques are acceptable forms of payment.
4. Cash is an unacceptable form of payment, as there is no proof of payment.

All sellers may verify their account via a $1.00 charge via paypal or moneybookers prior to selling their first item. This is a one time fee for us to ensure your registration matches your verified account information. We will review the payment as compared to your registration data to assure you are who you say. If it does not match, we will contact the seller via phone and email to verify the account further.

In addition to the above rules, here are some additional policy violations not permitted:

Seller Non-performance – Sellers must honor the transaction contract. Sellers cannot fail to deliver an item for which payment was accepted, significantly misrepresent an item by not meeting the terms and item description outlined in the listing, or refuse to accept payment for an item at the end of a successful sale.

Shill Bidding – Sellers must not bid on their own item, or have family members, roommates, or employees bid on their item.

Tax Policy – Sellers must pay relevant fees and taxes.

General Buying Terms for GameGavel.com

GameGavel’s policies are rules and guidelines that help to create a safe, fair and enjoyable trading environment for all members. As a buyer, you are responsible for reviewing and understanding the policies, as well as all applicable laws and regulations.

GameGavel’s policies are intended to:

1. Support government laws and regulations
2. Minimize risks to buyers and sellers
3. Provide equal opportunity to all buyers
4. Provide an enjoyable buying experience

Buyers may not:

Commit to purchasing an item (either by winning the item or buying an item in a Buy Out listing) without paying within 7 days of transaction close.

1. Bid with no serious intention of buying. Most of the items on GameGavel.com are auction-like listings and each bid is a binding contract.
2. Misuse the bid retraction option to manipulate the bidding process.
3. Bid on or buy an item when they do not meet the seller’s terms as outlined in the item listing, or bid or buy with the intention of disrupting a listing. This is known as shill bidding to artificially increase an item’s price or apparent desirability. Bidders on an item must be wholly independent from the seller of that item.

Both buyers and sellers cannot interfere with a transaction or offer to buy or sell listed items outside of the GameGavel.

Buyers understand the following:

GameGavel.com is only providing a service for people to buy and sell. We are in no way responsible for the auctions, descriptions, etc. in the auctions.
Transit times are not under the control of the sellers. Sellers can only control date of drop off with the selected carrier.
Items damaged during shipment are not the responsibility of the seller.

GameGavel’s policies are intended to:

2. Minimize risks to buyers and sellers
3. Provide equal opportunity to all buyers
4. Provide an enjoyable buying experience

Trading Partners May Not:

1. Commit to trading items without sending their respective item to the trading partner.
2. Offer a trade with no serious intention of trading. Each trade agreement is a binding contract.
3. Send an incorrect item to their trading partner.

Trading Partners agree to:

1. Provide Shipment Tracking information for their item.
2. Provide Shipment Insurance for their item if both trade partners agree to it.
3. Ship their item within 2 business days, excluding weekends.

Trade Partners understand the following:

1. GameGavel.com is only providing a service for people to buy, sell, and trade. We are in no way responsible for the auctions, descriptions, etc. in the listings.
2. Transit times are not under the control of the traders. Traders can only control date of drop off with the selected carrier.
3. Items damaged during shipment are not the responsibility of the trade partner.
